Frozen Fruit Mixtures Importer Loses Appeal of Tariff Challenge

The US Customs and Border Protection properly classified an importer’s frozen fruit mixtures under the harmonized tariff schedule of the US, a federal appeals court ruled.

Nature’s Touch Frozen Foods (West) Inc. failed to show how its mixtures should’ve been classified instead under a tariff provision for miscellaneous “food preparations” with a duty rate of 6.4%, Judge Todd M. Hughes said in a May 9 opinion. The US Court of Appeals for the Federal Circuit affirmed the US Court of International Trade’s judgment in favor of the US.
