Fresenius Medical Care Holdings Inc. prevailed at the First Circuit on Monday in a suit from MSP Recovery over alleged injuries linked to dialysis product GranuFlo.
MSP’s 2018 suit is barred by three- or four-year time limitations that started running in 2012 when Fresenius said GranuFlo can cause heart problems, the US Court of Appeals for the First Circuit said.
The ruling affirmed a lower court decision tossing MSP’s lawsuit bringing negligence and other claims against Fresenius.
