Fourth Circuit Rejects Man’s Bid to Enjoin USDA Proceedings

A man failed to convince the Fourth Circuit to reverse a lower court’s ruling allowing US Department of Agriculture proceedings against him to continue while he challenges in court the agency’s in-house judicial setup.

Joe Manis failed to demonstrate he’d suffer irreparable harm absent a preliminary injunction, the US Court of Appeals for the Fourth Circuit said in an unpublished per curiam opinion Monday. Although the district court rejected preliminary relief after finding Manis unlikely to prevail on his constitutional challenges, the Fourth Circuit declined to address the merits of those claims.
