Former Texas ‘Kung Fu Tea’ Franchisee Hit With Trademark Suit

A Texas-based tea shop is allegedly causing actual confusion by counterfeiting and willfully infringing its former franchiser’s trademarks.

KF Tea USA Inc. sued Tea N’ Boba Enterprises LLC, Toan Van Nguyen, and Vy Nguyen for failing to comply with agreement obligations after the parties split ways following alleged violations of a franchise agreement, according to the complaint filed Wednesday in the US District Court for the Northern District of Texas.

KF Tea alleged the defendants willfully infringed and counterfeited its registered Kung Fu Tea marks “by using the substantially indistinguishable Kung Fu Boba mark,” according to the complaint. The defendants’ ...
