A former University of Arizona track and field student-athlete successfully revived part of his lawsuit alleging sex-based discrimination and retaliation under Title IX.
The US Court of Appeals for the Ninth Circuit on Tuesday affirmed a district court’s dismissal of the claims against school coaches sued by plaintiff Michael Grabowski. And, while it also affirmed the dismissal of a discrimination claim, the three-judge panel vacated a portion of the lower court’s ruling with the option to amend.
