A former Rice University student disciplined after not fully disclosing his herpes diagnosis to a sexual partner convinced the Fifth Circuit to revive his suit claiming the school discriminated against him based on sex.

John Doe and Jane Roe began a sexual relationship in his first year at the school. He disclosed to Roe that he had contracted herpes in high school, but not that herpes can be transmitted asymptomatically and that the risk increases with unprotected sex.
