Former Oracle Director Can Pursue Retaliatory Termination Suit

Oracle America Inc. must face a retaliation claim by a former director of real estate who says he was fired after complaining he was discriminated against because he’s Latin American.

The close timing—one month—from when Mario Anicama made his complaint via an internal ethics hotline to when he was terminated adequately alleges that the two events were connected, the US District Court for the Northern District of California said. He didn’t need to additionally allege retaliatory animus, the court said in partially denying a motion to dismiss the case.
