Former CEO of eCapital Unit Advances Gender-Based Job Bias Suit

Financial services company eCapital Corp. and a subsidiary were denied dismissal of claims by the unit’s former chief executive officer that she was fired and otherwise discriminated against because she’s a woman and complained about gender bias.

The May 2023 lawsuit’s allegations support that the decision to remove Jennifer Palmer as CEO of eCapital Asset Based Lending Corp. was driven by a discriminatory intent, the US District Court for the Southern District of New York said. According to Palmer, she was constructively demoted in favor of a male managing director, who eventually succeeded her as CEO, the court said.
