Ford Gets ‘Track Ready’ Shelby Mustang Classes Trimmed on Appeal

Ford Motor Co.'s representations about its Shelby Mustang GT350’s racing capability are subject to classwide claims by sports car owners in four states, the Eleventh Circuit ruled Friday.

Some other state claims must be reexamined to determine whether a class can be certified, and others aren’t suitable for class treatment at all, Judge Kevin C. Newsom said for the appeals court.

The ruling is a partial win for Ford, which sought to overturn a lower court’s grant of class status to car owners in nine states—later narrowed to seven states on the plaintiffs’ initiative—on several types of claims. Common issues ...
