FMC Technologies Defeats Engineer’s Bid to Revive Overtime Suit

FMC Technologies Inc. defeated a former installation engineer’s bid to revive his overtime suit after a federal appeals court on Wednesday affirmed that he falls under the “learned professional” exemption.

The ex-employee argued that he wasn’t paid on a salary basis and that he performed a technician role involving manual labor. But he earned a $90,000 base salary and his primary duty required advanced knowledge obtained through his engineering degree, the US Court of Appeals for the Fifth Circuit said in an unpublished opinion.
