Flowers Foods Misclassified Arizona Distributors, Suit Alleges

Flowers Foods Inc. and a subsidiary misclassified bakery distribution drivers as independent contractors when they’re really employees and failed to pay appropriate wages, according to a federal lawsuit lodged in Arizona.

The wholesale baked goods company—known for its Nature’s Own, Dave’s Killer Bread, and Tastykake brands—and subsidiary Holsum Bakery Inc. rely on the distributors to deliver and stock their products, but because of the misclassification, didn’t pay them minimum wage and overtime, according to the complaint filed in the US District Court for the District of Arizona at Tucson.
