Florida school boards’ removal of books like ‘On the Road’ and ‘The Bluest Eye’ amounts to an unconstitutional interpretation of a state statute, a federal judge ruled Wednesday.

Authors, book publishers, and an authors’ union sued members of the Florida School Board of Education and two Florida school boards in 2024 seeking a judgment that a 2023 statue, HB1069, allowing parents to object to content depicting sexual conduct violates the First Amendment, as well as clarification regarding the statutes definition of the word, “pornographic.”
