A nonbinary guidance counselor failed to adequately allege that the School Board of Broward County, Fla., violated a state law that bars reprisals for reporting alleged child abuse, a Florida federal district court said.
Kezia Gilyard failed to allege sufficient facts showing a detrimental change to employment status because of the report, Judge William P. Dimitrouleas of the US District Court for the Southern District of Florida said in a March 7 order to dismiss the claim. Other claims in Gilyard’s complaint will proceed, the court said.
