Florida lawmakers’ new criminal penalties for migrants entering the state violate the US Constitution, immigrant rights and farm worker advocates claim in a federal lawsuit filed Wednesday.
Florida’s S.B. 4 “bypasses” federal immigration enforcement under the Immigration and Nationality Act, violating the Constitution’s Supremacy Clause and the Commerce Clause—two parts of the constitution that give federal law priority and empower Congress with controlling interstate economics. The complaint was filed in the US District Court for the Southern District of Florida.
