Florida Hospital’s Slip & Fall Report Protected From Discovery

The federal Patient Safety and Quality Improvement Act’s privilege for “patient safety work product” applies to a hospital report detailing a visitor’s slip and fall, a state appeals court said.

Kimberly Beylotte can’t compel Shands Teaching Hospital to turn over the report because it met the prerequisites for the PSQIA’s protection, the Florida District Court of Appeals, First District said.

The PSQIA’s privilege for materials created for a patient safety organization applied even though the report wasn’t a medical record and Beylotte wasn’t a patient, the court said.
