FirstEnergy Stops Internal Probe Disclosure in Investors’ Suit

FirstEnergy Corp. won’t have to disclose to shareholders suing the company for securities violations the insights of two internal investigations following former Ohio House Speaker Larry Householder’s indictment.

FirstEnergy convinced a US Court of Appeals for the Sixth Circuit panel that the district court erred in ordering the production of documents to the investors. The company faces irreparable harm and is “likely to succeed at least” on its arguments that the district court incorrectly applied the attorney-client privilege and work-product doctrine, the court said, granting FirstEnergy’s request to stay the district court order.
