A Colorado wireless data company can pursue its legal malpractice claims against Hamilton, Brook, Smith & Reynolds PC after the First Circuit ruled the parties had an attorney-client relationship “as a matter of law.”
Judge O. Rogeriee Thompson, of the US Court of Appeals for the First Circuit, said in a Monday opinion that the question of whether the company had asserted its malpractice allegations in a timely way is a question for a jury, ruling that there are factual disputes that make the lower court’s grant of summary judgment to the law firm erroneous.
