First Circuit Reverses Temporary Halt on Maine 72-Hour Gun Rule

Maine convinced a panel of First Circuit judges to reverse a lower court order pausing enforcement of the state’s three-day waiting period on firearm sales while it faces a constitutional challenge.

The state’s 72-hour “cooling off-period” before individuals attempting to purchase a firearm can acquire the weapon is likely constitutional, the US Court of Appeals for the First Circuit said Friday.

The law only imposes limitations in certain circumstances on when an individual can acquire a firearm after purchase, which doesn’t implicate conduct protected by the Second Amendment, Judge Seth R. Aframe wrote.
