A federal district court’s universal preliminary injunction against President Donald Trump’s executive order banning birthright citizenship will stay in place pending appeal, the First Circuit said Tuesday.
The administration sought to stay the injunction, arguing that the 18 states that filed the lawsuit lacked standing. But Chief Judge David J. Barron said that the government didn’t make a strong showing that the states lacked standing under Article III of the US Constitution or third-party standing principles.
