Fired King & Spalding Lawyer Loses Benefit Interference Claim

A former King & Spalding LLP associate who accused the firm of firing him shortly before he was scheduled to vest in a $20,000 retirement plan contribution lost his claim for ERISA benefit interference in Manhattan federal court.

David Joffe failed to show that King & Spalding’s reasons for firing him—his alleged failure to submit a business practice plan or participate meaningfully in his own career development—were pretext for unlawful interference with his rights under the Employee Retirement Income Security Act, the court said.
