Fincantieri Secures Dismissal of Employee Data Breach Claims

American shipbuilder Fincantieri Marine Group LLC convinced a Wisconsin appellate court to dismiss an employee class action over a 2023 cyberattack that leaked Social Security numbers and health insurance information.

Without allegations that identity theft has already occurred, the employees can’t demonstrate that the risk of future harm is sufficiently imminent or certainly impending to confer standing, the Wisconsin Court of Appeals said Tuesday, affirming a lower court decision. The risk of future harm is for now too attenuated and speculative.
