The owners of a commercial property will face reinstated Americans with Disabilities Act claims over the lack of van-accessible parking for customers because a trial court wrongly discounted the plaintiff’s testimony as a serial litigant.
The trial court improperly focused on plaintiff Chris Langer’s past ADA litigation “to impugn his credibility, expressing doubt that Langer would return” to the allegedly access-impaired Gour Maine Lobster because of the previous lawsuits he filed, the US Court of Appeals for the Ninth Circuit ruled in an opinion written by Judge Ronald M.
