Fiji Water Prevails Over Federal Class Action Microplastics Suit

Fiji Water’s parent company persuaded a federal court to toss a proposed class action suit claiming the water is deceptively advertised as natural while containing microplastics.

The plaintiffs—consumers who bought Fiji water—failed to show the product actually contained microplastics, the US District Court for the Northern District of Illinois said Monday.

Allowing the suit to proceed would “basically open the door to enabling any purchaser of any consumable product to file a lawsuit simply saying, ‘I bought product X, and it contains microplastics’ (or ‘forever’ chemicals, or heavy metals, or whatever) and thereby get past a motion to dismiss,” Judge ...
