Fifth Third Faces Trial on Older Female Worker’s Promotion Claim

A trial is needed to decide whether Fifth Third Bank NA denied a woman in her 60s promotion to senior credit officer because of her age and gender, a Louisville federal judge ruled.

The decision entered Monday by the US District Court for the Western District of Kentucky shows that evidence of discriminatory remarks relating to an employment decision doesn’t have to amount to direct proof of bias to help a worker prove their case.
