Fifth Circuit Doubts Migrant Group’s Standing in Texas SB4 Case

Enforcement of a Texas law authorizing state-level arrests and deportations could be allowed by the Fifth Circuit as several judges indicated during oral arguments Thursday the migrant advocacy group challenging the law may lack standing.

A lower court ruled that the law violates a long standing principle that immigration policy is the domain of the federal government, not states more than two years ago.

Trump-appointed Judge James Ho said there are multiple ways to resolve the case, perhaps most easily with a conclusion that the nonprofit Las Americas Immigrant Advocacy Center lacks standing.
