Fifth Circuit Again Allows Texas Immigration Law to Take Effect

The Fifth Circuit again allowed Texas’ state-level arrest and deportation law to temporarily go into effect.

In an unpublished, single-page order Friday evening, the US Court of Appeals for the Fifth Circuit stayed Judge David Ezra’s injunction of the law, S.B. 4, which has been volleying between the district and circuit courts. The order notes that Circuit Judge Leslie H. Southwick would have denied the motion.

The order comes in a case challenging Texas’ law allowing for the arrest of people entering the country illegally, brought by a lawful permanent resident of the US.
