Fence for Stolen Military Scopes Loses Bid to Undo Conviction

A man found guilty of conspiring to steal government property lost his appeal to undo the conviction after the Eleventh Circuit said incriminating statements he made during a set of proffer sessions were properly admitted.

The district court didn’t abuse its discretion when it admitted 14 proffer statements after deciding Steve Bonner triggered the proffer agreement’s waiver provision, the appeals court said Wednesday.

Bonner’s opening statement and questions during cross-examination “presented to the jury an alternative factual theory that conflicted with his proffer statements, triggering the waiver provision,” the US Court of Appeals for the Eleventh Circuit said.
