FEMA Analyst to Get Bias Trial Over Benching for Time Card Issue

A FEMA program analyst may be able to prove disability bias and retaliation drove her second-line supervisor to falsely report her for suspected time card fraud, resulting in the suspension of her security clearance and pay, a D.C. federal judge ruled.

If she can do so, Cindy Brackett will be entitled to an exception to the general rule that federal workers can’t use the judicial process to challenge adverse employment actions stemming from an executive branch agency’s decision to deny or revoke an employee’s security clearance, the U.S. District Court for the District of Columbia said.
