The federal bar on felons possessing a gun can be constitutionally enforced against a woman with a nonviolent criminal record, the Tenth Circuit said Tuesday.
The ruling reaffirmed the US Court of Appeals for the Tenth Circuit’s 2023 decision finding the law applicable to Melynda Vincent, who was convicted of bank fraud. The US Supreme Court vacated that decision and sent it back to the appeals court for reconsideration in light of the high court’s 2024 United States v. Rahimi, which upheld a gun ban on people subject to domestic violence restraining orders.
