FedEx Reports on Contractors Shielded in Driver Overtime Suit

FedEx Ground Package Systems Inc. won’t have to turn over reports on independent service providers prepared by its legal division in the past four-and-a-half years to attorneys representing Massachusetts delivery drivers in a collective action for unpaid overtime, a federal magistrate judge ruled.

The compliance investigation reports prepared after June 2019 and related documents are shielded by the attorney work product doctrine, US Magistrate Judge Katherine A. Robertson, of the US District Court for the District of Massachusetts, ruled Oct. 27.
