FedEx Manager’s $366 Million Retaliation Win Probed by 5th Cir.

FedEx Corporate Services Inc. may have convinced the Fifth Circuit on Monday to substantially reduce a $366 million award to a Black former manager for job retaliation, but questioning by the judges suggests it could be stuck with the jury’s liability finding.

The October 2022 verdict in favor of Jennifer Harris awarded her more than $1 million in compensatory damages for the FedEx Corp. subsidiary’s violation of Title VII of the 1964 Civil Rights Act and 42 U.S.C. §1981, plus $365 million in punitive damages.
