FedEx Defeats Older Black Driver’s Discrimination, Reprisal Suit

Federal Express Corp. prevailed in a former ramp transport driver’s lawsuit alleging he was fired because of his race and age.

There was no evidence of a White or younger employee who wasn’t terminated under similar circumstances, the US District Court for the District of Connecticut said. FedEx fired the 62-year-old Black man over his altercation with a security officer at Newark Airport, and the employees outside his protected class to which he pointed didn’t hold the same job as him and weren’t involved in a similar incident, the court said.
