FDA Defeats Parents’ Challenge to Covid Vaccine Authorization

Parents who object to vaccinating their children against Covid-19 can’t sue to force the federal Food and Drug Administration to revoke orders authorizing the shots for minors, a federal court in Texas said.

The parents and their representative, Children’s Health Defense, lacked standing because their complaint didn’t demonstrate that the FDA’s action meant that their children were substantially likely to be inoculated without their knowledge and consent, the US District Court for the Western District of Texas said.

The court dismissed the first amended complaint with prejudice, meaning that the plaintiffs didn’t get another chance to amend it.
