FCC Order Banning Chinese Telecom Products Partly Upheld

The Federal Communications Commission didn’t overstep its authority in banning the products of two Chinese-owned manufacturers from being used to provide video surveillance of critical infrastructure in the US, a federal appeals court ruled.

The products of Hikvision USA Inc. and Dahua Technology USA Inc. were properly subject to the FCC ban under the provisions of the Secure Equipment Act, which was passed in November 2021 to address national-security risks posed by telecommunications products that could be used by the Chinese government to spy on sensitive US infrastructure, the US Court of Appeals for the D.C. Circuit said Tuesday.
