Fastenal Loses Bid to Throw Out NY Manual Worker Pay-Delay Case

Fastenal Co. must face allegations that it paid manual workers every two weeks instead of weekly, in violation of New York law, after a federal judge rejected the company’s bid to toss the case.

The former employee who sued the construction supply firm sufficiently alleged an injury in the form of the lost time value of his wages and has standing to sue, the US District Court for the Northern District of New York said, adding that the state law includes a private right of action for untimely wage payments.
