Farmers Insurance must turn over documents in an Ohio lawsuit alleging the company dragged its feet in a bad-faith effort to stall an underinsured motorist claim.
The files sought aren’t protected by attorney-client privilege, as Farmers had asserted, an Ohio appeals court said Friday in affirming the trial court’s decision.
Farmers customers, Melissa and Alexis Eddy, are entitled to “portions of the claims file showing a lack of good faith up to the benefit-payment date,” the court said, also shooting down an argument from Farmers that a judge review the file to determine what portions should be made available.
