A man serving two and a half years in prison for selling $43,000 worth of counterfeit baseball cards lost an appeal challenging his sentence, after the Sixth Circuit said the trial court was allowed to rely on a much higher “intended loss” figure.
Instead of using $43,000 as the loss amount for purposes of calculating Bryan Kennert’s sentence, the court relied on an intended loss of $1.09 million. The figure was based on the value of additional counterfeit baseball cards—including a 1916 Babe Ruth card—found during a search of his residence.
