Exxon Refinery Poisoning Case to Hinge on ‘Vapor,’ Trespass Law

A federal appeals court pondered at oral arguments Monday whether potentially toxic vapors coming from soil near an Exxon Mobil gas refinery in California could violate state trespass law.

Residents of Torrance, Calif.—part of Los Angeles County—are seeking to revive their lawsuit against Exxon alleging its century-old refinery leaked toxic petroleum products into the ground, causing vapors to rise up from the soil in nearby properties.

Judges for the US Court of Appeals for the Ninth Circuit questioned whether the residents had properly advanced their theory that the toxic substance leakage into private properties was a trespass.
