Desktop Metal Inc. and former board members of ExOne Co. beat a lawsuit alleging the companies failed to timely disclose material information prior to their $575 million merger.
A former ExOne shareholder who brought the suit failed to adequately allege that two “relatively minor events” at Desktop Metal were material to ExOne stockholders voting on the 3D printing companies’ merger, Vice Chancellor Lori W. Will, of the Delaware Chancery Court, wrote in a Tuesday opinion dismissing the suit.
