Exelon Wins Cuts to Job Retaliation Suit Over Litigation Conduct

A former Exelon employee can pursue a retaliation claim alleging she wasn’t fully paid for helping the company with coworkers’ bias cases but allegations regarding other litigation-related reprisals failed, a Baltimore federal judge ruled.

The US District Court for the District of Maryland decision Tuesday is noteworthy for recognizing an exception to the usually expansive definition of retaliation under federal discrimination law. Stacey Jackson’s lawsuit turned on whether alleged pay backs by Exelon Business Services Co., Exelon Corp., Baltimore Gas & Electric Co., and in-house and outside attorneys for the companies constituted adverse action under federal and state anti-discrimination laws. ...
