ExecuPharm Inc. succeeded for the second time in convincing a federal court to dismiss some claims in a proposed class action alleging it failed to protect employees’ personal information in a 2020 data breach.
Plaintiff Jennifer Clemens failed to show in her amended complaint that ExecuPharm had a fiduciary relationship or confidential relationship with her, a necessary basis for her claims of breach of fiduciary duty and breach of confidence, Judge Gerald J.
