ExecuPharm Trims Claims in Class Action Over 2020 Data Breach

ExecuPharm Inc. succeeded for the second time in convincing a federal court to dismiss some claims in a proposed class action alleging it failed to protect employees’ personal information in a 2020 data breach.

Plaintiff Jennifer Clemens failed to show in her amended complaint that ExecuPharm had a fiduciary relationship or confidential relationship with her, a necessary basis for her claims of breach of fiduciary duty and breach of confidence, Judge Gerald J. Pappert of the US District Court for the Eastern District of Pennsylvania said Thursday.
