Execu-Search Recruiter’s Unpaid Overtime Suit Gets Trimmed

A former recruiter for the Execu-Search Group LLC can proceed with part of her proposed class action alleging she and other workers were unlawfully denied overtime because they were misclassified as exempt under the Fair Labor Standards Act.

Judge Mary Kay Vyskocil, of the US District Court for the Southern District of New York, on Wednesday partly granted ESG’s motion to dismiss Katie Brain’s FLSA and New York Labor Law claims, but allowed some of the suit to proceed.
