Ex-Wipro Workers Can Reassert Disparate Impact Claim, Judge Says

A group of former Wipro Ltd. workers can reassert their disparate impact discrimination claim against the Bangalore, India-based company, a federal magistrate judge said.

The belated discovery of a Wipro policy that “mandates the rotation of tenured visa employees into U.S.-based roles” is enough to pursue their class claim that the company’s policies have a disparate impact on people of non-South Asian and non-Indian origins, Magistrate Judge J. Brendan Day of the US District Court for the District of New Jersey wrote in a Tuesday order.
