Ex-USPS Employee Fails to Revive Complaint Over Alleged Ouster

A former US Postal Service employee who resigned while his claim was pending before an administrative agency didn’t credibly allege he was, in essence, forced out, the Federal Circuit said Thursday in a precedential ruling.

The record shows Saeed Tavakkol “had two alternatives in front of him, resign or stand and fight, and he chose the former,” Judge Kara F. Stoll wrote. Tavakkol alleged an “involuntary resignation” after facing harassment, retaliation, and improper handling of his medical issues, but Stoll dismissed his assertions and upheld a ruling by the Merit Systems Protection Board.
