Ex-University of Kansas Professor Wins False Statement Appeal

A former University of Kansas professor convicted of making a false statement on an internal KU “Institutional Responsibilities” form won his appeal challenging the charge on Thursday.

The government failed to prove that his statement to his employer was material to any Department of Energy or National Science Foundation decision, the US Court of Appeals for the Tenth Circuit said.

Both of the agencies received and funded the relevant grant proposals before Feng “Franklin” Tao submitted his institutional responsibilities form to KU, and the university never applied for additional funding afterwards, Judge Nancy L. Moritz said.
