Ex-Tesla Workers Ask Fifth Circuit to Revive Mass Layoff Dispute

Three former Tesla Inc. factory workers asked the Fifth Circuit to reverse the dismissal of their proposed class case over the company’s alleged failure to comply with notice requirements for mass layoffs.

The workers accuse Tesla of violating the Worker Adjustment and Retraining Notification Act when it fired them without advance notice as part of a 2022 effort to trim its workforce by 10%. A Texas district judge acted too quickly in dismissing the suit after sending the claims to arbitration, the workers said in a brief filed in the US Court of Appeals for the Fifth Circuit.
