Ex-School Employee Can Pursue Religious Discrimination Claims

An ex-high school administrator alleging he was fired for sharing his Christian beliefs in opposition to a school play can pursue discrimination claims after a federal appeals panel ruled he sufficiently pleaded his case.

Corey McNellis’ previously dismissed discrimination claims under Title VII and Colorado law were reversed by a panel with the US Court of Appeals for the Tenth Circuit on Tuesday, according to a unanimous opinion. But the panel affirmed a lower court’s dismissal of McNellis’ claims against the Douglas County School District for violating the First Amendment and firing him in retaliatory fashion.
