Pennsylvania’s juvenile probation service didn’t unlawfully terminate former officer Kelly Sinico over time off Sinico sought for an embryo-transfer procedure, a federal appeals court said, affirming a lower court’s summary judgment ruling for Pennsylvania.
The US Court of Appeals for the Third Circuit reviewed the lower court’s decision for “clear error” rather than de novo because Sinico failed to object to a magistrate judge’s report and recommendation that the district court adopted, and “we see no reason to excuse her failure,” Judge Tamika R. Montgomery-Reeves said, citing another Third Circuit case taking the same approach.
