Ex-New Milford Officers’ Appeal Over Qualified Immunity Dismissed

An interlocutory appeal by the Town of New Milford in Connecticut and two of its former police officers of an order denying their motion for summary judgment based on qualified immunity was dismissed Friday by the Second Circuit.

Because the trial court’s denial of qualified immunity turns on disputed factual issues, rather than a pure question of law, the US Court of Appeals for the Second Circuit lacks jurisdiction to hear the appeal, the summary order said.
