Ex-Mormons Argue Church’s ‘Misrepresentations’ Constitute Fraud

A Tenth Circuit panel weighed the scope of a legal doctrine that steers courts clear of internal church disputes during Monday arguments between The Church of Jesus Christ of Latter-day Saints and three former members who claim they were misled by church leaders.

Three ex-Mormons brought a civil RICO suit alleging that the church publicly misrepresented key details about its history and made misleading statements about how tithing funds would be used. The church argued that the ex-members had no right to bring their religious dispute with the faith into a secular court.
